This article aims to investigate the protection regime of access and licensing of knowledge conveyed by Brazilian journals of upper stratum (A1 and A2) related to Exact, Technological and Multidisciplinary Sciences Area in CAPES Qualis Journals system. The research problem could be expressed by the question: how are editorial policies of these journals constituted taking into account the current Brazilian copyright legislation? Stemming from the notions of duty and the aspiration of the law, as well as the techniques of argumentation 'inside' and 'beyond' the machine, it is possible to infer that the editorial policies of these journals reveal a rupture with the traditional copyright system.
