Abstract

The International Refugee Regime is in crisis. The Hungarian reaction to the intense migratory flow of Syrians seeking refuge in Europe is a demonstration of such a crisis. It is proposed to discuss in this article the conceptual history of the refugee status, the challenges imposed on the refugee regime and its implications in the European case. The reflection on the rise of new categories of migration and the consequent relativization of the 1951 Convention call into question the rights of refugees and the entire legal framework for the security of those who migrate involuntarily because of a direct threat to their lives.
