Segurança Humana para quem? Um breve estudo sobre os refugiados no território japonês à luz do sistema jurídico e político-institucional / Human Security for whom?

Resumo

Este artigo analisa a situação dos refugiados no Japão, considerando o quadro jurídico e político-institucional, a fim de perceber a real situação desses migrantes em território japonês e debatê-la à luz do discurso de segurança humana nipônico. Faz-se, então, um histórico das questões jurídicas, políticas e de estatísticas relacionadas aos refugiados no Japão desde 1981, com a ratificação da Convenção da Organização das Nações Unidas para Refugiados, embora o foco do artigo volte-se ao pós-década de 1990, quando o Japão passou a difundir o discurso de segurança humana. Assim, aborda-se o quadro atual dos refugiados no Japão, considerando as fragilidades de atuação do Estado japonês frente aos procedimentos relacionados aos refugiados, problematizando-os por meio do discurso de segurança humana.

Human Security for whom? A brief study on refugees in Territory Japanese under the legal and political-institutional system

Abstract: This essay analyzes the situation of the refugees in Japan, considering the law and political-institutional framework, seeking to perceive the real situation of these migrants in Japan’s territory and to debate it in the light of Japanese human security discourse. So, it presents a historic summary, considering questions related to law, politics and statistics about the refugees in Japan since 1981, with the ratification of United Nations Convention about the Refugees, although the articles’ focus turn to the period after 1990, when Japan passed to disseminate human security discourse. Then, it presents the current framework of the refugees in Japan, considering the fragilities of the Japanese state actions facing the procedures related to the refugees, questioning them by the human security discourse.
